Federal law changes on November 12, 2026. Public Law 119-37 narrows the federal definition of hemp by moving to a total-THC standard that includes THCA and by excluding certain hemp-derived cannabinoid products from the federal hemp definition. This is frequently described in the industry as a “federal hemp ban,” but it is not a ban on all hemp. Industrial hemp and products that continue to satisfy the amended federal definition may remain hemp. Products that fall outside the amended definition may be treated as marijuana under the federal Controlled Substances Act unless Congress changes the law again.
